1. INTRODUCTION
www.kerrygallopjewellery.com (“site”) is owned and operated by Kerry Gallop trading as Kerry Gallop Jewellery, a sole trader based in England and Wales. Our registered office and business address is located at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.
Please read these terms and conditions carefully before placing an order. By purchasing products on this site, you agree to be bound by these terms and conditions. If you are not willing to be bound by these terms and conditions, please do not purchase products on this site.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.
2. CHANGES TO TERMS
We reserve the right, at our discretion, to modify, add, or remove any or all of these terms and conditions at any time and each such change shall be effective immediately upon posting. Please check these terms and conditions periodically for changes.
Your continued use of this site and purchase of products on this site following the posting of changes to these terms and conditions will mean you accept those changes. Please check the terms before every purchase.
If the revised terms apply to your order, we will notify you of the changes. If you intend to cancel the Contract with us upon such changes, you may cancel either in respect of all the affected Products or just the Products you are yet to receive. If you opt to cancel, you shall return (at our cost) relevant Products you have already received and we will refund the price you have paid, including any delivery charges.

Registration and other information provided by you is subject to our Privacy Policy and shall only be used in accordance with it. For more information, please go to our Privacy Policy.
4. PRODUCTS
Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Returns and Refund Policy.
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
Each piece of jewellery is handmade and may feature slight variations in appearance. All sizes, dimensions and measurements indicated on our site have a tolerance of 2%. Images on the website are for illustrative purposes only.
Our products are made from 925 sterling silver unless otherwise stated. Care instructions will be provided to maintain your jewellery.
While we use high-quality materials, we cannot guarantee that our jewellery will not cause allergic reactions.
5. AGE RESTRICTION
You must be at least 18 years old to purchase any products from our site.
6. ACCEPTANCE OF ORDER
6.1 These Terms will become binding on you and us and a Contract will come into effect between you and us only upon our written acceptance of your order issued to you by email (Dispatch Confirmation). We are not bound by the Order unless we accept it in writing.
6.2 If there is a conflict between these terms and any term of your order, the order will take priority.
6.3 An order number will be assigned to you upon acceptance. You should quote this number in all subsequent correspondence relating to the order.
6.4 If you have already paid for the products and we are unable to supply you with a product because the product is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our site, we will notify you and will refund you the full amount (including any delivery costs charged) as soon as possible.
6.5 We reserve the right to refuse or cancel orders for any reason, including stock availability or payment issues.
7. ENTIRE AGREEMENT
These Terms and the Privacy Policy constitute the entire agreement between you and us and supersedes all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to its subject matter.
8. REPRESENTATIONS
8.1 You acknowledge and agree that by entering into this Contract with us you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms or the Privacy Policy.
8.2 You shall not have any claim for innocent or negligent misrepresentation against us based on any statement in this Contract.
8.3 Except as expressly stated in these Terms, we do not give any representation, warranties or undertakings in relation to the Products. Any representation, condition or warranty which might be implied or incorporated into these Terms by statute, common law or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that the Products are suitable for your purposes.
9. RIGHT TO CANCEL
9.1 Your legal right to cancel a contract starts from the date on which you receive the Dispatch Confirmation.
9.2 You have a legal right as a consumer to cancel a contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 within 14 days after the day on which you received the product.
9.3 If during the relevant period you intend to cancel the Contract with us, you can notify us of your decision and receive a refund. You can obtain advice on your legal right to cancel the Contract from your local Citizens' Advice Bureau or Trading Standards office.
9.4 Exceptions include personalised items or products that have been unsealed for hygiene reasons.
10. RETURN AND REFUND
a) Returns are accepted within 14 days of receipt, provided the item is unused and in its original packaging. Custom or personalised items are non-refundable unless faulty. For hygiene reasons, we regret that refunds cannot be offered on earrings.
b) To initiate a return, email us at sales@kerrygallopjewellery.com with your order details. Customers are responsible for return shipping costs.
c) Refunds will be processed to the original payment method within 14 days of receiving the returned item.
d) If you have returned the products because they are faulty or mis-described, we will refund the price of the Products in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the item to us.
e) We do not currently offer direct exchanges. If you would like a different item, please return your original purchase for a refund and place a new order.
11. DELIVERY
11.1 We will inform you of the estimated delivery date, which will be within 30 days after the date of the Dispatch Confirmation. Our delivery date may occasionally be affected by circumstances beyond our control.
11.2 If delivery is delayed, you may cancel the order if timely delivery was essential.
11.3 Delivery of Products to International Delivery Destinations will be subject to applicable import duties and taxes payable by you. Prior to placing an order you should contact your local customs office for information on this.
11.4 You agree to comply by all applicable laws of country to which Products are delivered and we shall not be liable for any such violations.
12. PRICE AND DELIVERY CHARGES
12.1 Prices of the Products are specified on our site and confirmed on the checkout page. We may change our prices any time, but that will not affect the prices for confirmed orders.
12.2 Prices exclude delivery costs, which will be added at checkout.
12.3 Despite our best efforts, there may be incorrect prices on some of the Products. If the Products' correct price is less than a price shown on our site, the lower amount will be charged. If the Products' correct price is higher than the price specified on our site, we will inform you of this and ask whether you wish to continue with the order with the actual higher price. If the error in price is obvious, unmistakable and mispricing could have been recognised reasonably by you, we will not be liable to provide the Products to you at the lower price that was incorrect.
13. PAYMENT
Payment for products is to be made in advance by credit or debit card. Your credit or debit card will not be charged until the products are dispatched to you. We accept the following methods of payment: credit/debit cards, PayPal.

Certain content, products and Services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
15. USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

We are not liable for damage resulting from improper use or care of our jewellery.
While we strive for accuracy, we do not guarantee that our website will be free from errors or interruptions.
17. CIRCUMSTANCES BEYOND OUR CONTROL
17.1 If there is failure to perform, or delay in performance of any of our obligations under these Terms due to Circumstances Beyond Our Control, we will not be liable for such failure.
17.2 Circumstances Beyond Our Control include any act or event beyond our reasonable control, including without limitation lock-outs, strikes, or other industrial action by third parties, riots, civil commotion, terrorist attack or threat of terrorist attack, invasion, war (whether declared or not) or threat or preparation for war, explosion, fire, flood, storm, subsidence, epidemic, pandemic, earthquake, or other natural disaster, or failure of private or public telecommunications networks.
17.3 If any Circumstances Beyond Our Control affects the performance of our obligations under these Terms:
a) you will be notified as soon as reasonably possible; and
b) the time for performance of our obligations will be extended and our obligations under these Terms will be suspended for the duration of the Circumstances Beyond Our Control. If the delivery date is affected by the Circumstances Beyond Our Control, we will reschedule the delivery date with you after the Circumstances Beyond Our Control are over.
c) If Circumstances Beyond Our Control occur and you do not wish us to provide the Products, you may cancel the contract in accordance with clause 9. We may cancel the contract if the Circumstances Beyond Our Control continues for more than 8 weeks in accordance with our cancellation rights in clause 9.
18. INTELLECTUAL PROPERTY
All content on our website, including images, text, and designs, is owned by Kerry Gallop Jewellery and protected by copyright laws.
You may not use, reproduce, or distribute any of our content without prior written consent.
19. GOVERNING LAW AND DISPUTES
These Terms are governed by English law, and any disputes will be handled in the English courts.
In the event of a dispute, we encourage you to contact us directly to seek resolution. If necessary, disputes will be handled through the UK legal system.
